The law, passed in December 2024, according to the Governor’s office, requires platforms to detail how they handle extremism, disinformation, and harassment, with potential fines reaching $15,000 per day for violations. In its filing, X claims that deciding what content is acceptable involves drawing a line that is subject to considerable debate, asserting that “this is not a role that the government may play.”
This legal gambit transforms Musk’s “free speech absolutist” philosophy, a term noted by Reuters, into a direct constitutional confrontation, questioning the authority of governments to regulate platform transparency.
The move comes as both X and its competitors navigate a fraught landscape of political pressure and shifting public expectations. In a joint statement, New York legislators Brad Hoylman-Sigal and Grace Lee, who sponsored the bill, said Musk’s resistance demonstrates precisely why the law is needed. “The fact that Elon Musk would go to these lengths to avoid disclosing straightforward information to New Yorkers shows why the law is necessary.”
