The U.S. Consumer Product Safety Commission (CPSC) has determined that Amazon must recall over 400,000 items deemed dangerous and sold through third-party vendors. This decision marks Amazon as a “distributor” under federal regulations, making the company accountable for ensuring these products adhere to safety standards.
Products Identified as Dangerous
The unsafe items include carbon monoxide detectors that fail at their primary function, hairdryers lacking sufficient electrocution protection, and children’s sleepwear that doesn’t meet federal flammability requirements.
These products, sold via Amazon’s Fulfilled by Amazon (FBA) service, have been classified as posing a “substantial product hazard” under the Consumer Product Safety Act. The CPSC critiqued Amazon for inadequately warning the public about these hazards and not implementing satisfactory measures to ensure the products’ return or destruction.
Administrative and Legal Proceedings
This ruling follows a three-year administrative complaint brought by the CPSC. The Commission accused Amazon of distributing products that posed significant safety risks. Although Amazon did acknowledge the products were hazardous, it argued against being seen as a distributor responsible for public safety measures. Amazon’s stance that notifying original buyers and offering credits was sufficient was dismissed by both the CPSC and an administrative law judge.
Amazon must now formulate detailed plans for the CPSC on how it will inform consumers about the dangerous products and encourage their safe return or disposal. Recalls highlight the need for strict safety standards and corporate responsibility in the online retail sector.
Specific Recalls Highlight Safety Concerns
In July, the CPSC issued four recalls for products sold exclusively on Amazon. These recalls covered children’s pajamas with flammability issues, pool drain covers not meeting safety standards, twin strollers failing several safety regulations, and area rugs posing fire risks. CPSC’s recall notice underline persistent safety issues related to third-party products on significant e-commerce platforms.
The CPSC’s unanimous verdict against Amazon, a company with $575 billion in revenue, emphasizes the firm’s responsibility as a distributor of unsafe products. The Commission will review Amazon’s proposed plans and subsequently issue directives on notification and remedies. The order follows the authorization of an administrative complaint against Amazon on July 14, 2021, for selling items that are considered substantial product hazards.
